1. Agreement to these terms
These Terms of Service (the “Terms”) form a binding agreement between you and Booksfer, LLC. They govern your use of the booksfer.com website, the reading platform we operate, our mobile applications, and any related services (together, the “Service”).
By creating an account or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.
2. Who we are
The Service is operated by Booksfer, LLC, a limited liability company formed under the laws of the State of Delaware, United States, on 28 February 2025, with its registered office at 131 Continental Drive, Suite 305, Newark, DE 19713, United States.
3. Eligibility
You must be at least 13 years old to use the Service, or older where your local law requires a higher minimum age for online services. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian, who accepts these Terms on your behalf.
By using the Service you confirm that you are not barred from doing so under the laws of the United States or your own jurisdiction.
4. Your account
- You must give accurate information when creating an account and keep it up to date.
- You are responsible for keeping your credentials confidential and for all activity that happens under your account.
- Tell us promptly at info@booksfer.com if you believe your account has been accessed without your permission.
- One person may not maintain multiple accounts in order to evade a restriction or suspension.
5. Your content and the licence you grant
You keep ownership of everything you create and upload — manuscripts, chapters, cover images, comments and reviews (“Your Content”). Booksfer, LLC does not claim authorship or ownership of Your Content.
To operate the Service, you grant Booksfer, LLC a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, transmit and display Your Content, and to make excerpts of it available for promotion and discovery within the Service. This licence exists only so that we can run the platform. It ends when you remove Your Content, except for copies retained in routine backups and where we must keep records to comply with the law.
You confirm that you own Your Content or have all rights necessary to publish it, and that it does not infringe anyone else’s rights.
6. Publishing as an author
- You choose whether a work is free or paid, and you set its release schedule within the options the platform provides.
- You are responsible for the accuracy of the metadata, content warnings and age ratings you apply to your work.
- We may decline to publish, or remove, a work that breaches these Terms or applicable law. Where we do, we will tell you why unless we are legally prevented from doing so.
- Author earnings are calculated on the revenue share shown in the author terms at the time of publication, and paid according to the payout schedule stated there.
- You are responsible for your own tax obligations on the amounts you receive.
7. Purchases, subscriptions and payment
Some content and features are paid. Prices are shown before purchase and include applicable taxes where we are required to collect them.
- Payments are handled by third-party payment processors and, for mobile applications, by the relevant app store. Booksfer, LLC does not receive or store your full payment card details.
- Subscriptions renew automatically for the stated period until cancelled. You may cancel at any time, and the cancellation takes effect at the end of the current billing period.
- Where you purchase through a mobile app store, that store’s own purchase, billing and cancellation terms also apply to the transaction.
- Digital currency or credits purchased on the platform have no cash value outside the Service and are not transferable.
8. Refunds
Digital content is delivered immediately, so purchases are generally final. We will nonetheless issue a refund where content was not delivered, where it is materially different from its description, or where a refund is required by the consumer law that applies to you.
For purchases made through a mobile app store, refunds are administered by that store under its own policy. Requests for purchases made directly on our own platform should be sent to info@booksfer.com within 14 days.
9. Acceptable use
You agree not to:
- upload content you do not have the right to publish, including plagiarised or pirated work;
- publish material that is unlawful, that sexualises minors, that incites violence, or that harasses or defames another person;
- misrepresent yourself as another author or person;
- attempt to bypass access controls, scrape the Service at scale, or download content for redistribution;
- interfere with the operation or security of the Service, or probe it for vulnerabilities without our written permission;
- use the Service to distribute malware or unsolicited commercial messages;
- manipulate ratings, reviews, reading statistics or earnings by artificial means.
10. Our intellectual property
The Service itself — the software, interface, design, and the Booksfer name and logo — belongs to Booksfer, LLC and is protected by intellectual property law. These Terms give you a personal, non-transferable, revocable licence to use the Service; they do not transfer any ownership to you. You may not copy, modify, reverse-engineer or create derivative works from the Service except to the extent that applicable law says you may.
11. Copyright complaints
Booksfer, LLC responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice to info@booksfer.com including:
- identification of the work you say has been infringed;
- the location of the material on the Service;
- your contact details;
- a statement that you believe in good faith that the use is not authorised; and
- a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act for them.
We remove or disable access to material that is the subject of a valid notice, and we terminate the accounts of repeat infringers.
12. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access where you materially breach these Terms, where required by law, or where continued access would create a risk to other users or to the Service. Where we terminate an account, we will give notice and, where practicable, an opportunity to export your content.
Sections 5, 10, 13, 14, 15 and 16 survive termination.
13. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Booksfer, LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that content published by other users is accurate or lawful.
Nothing in these Terms excludes a liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence or for fraud.
14. Limitation of liability
To the fullest extent permitted by law, Booksfer, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars (USD 100).
15. Indemnity
You agree to indemnify and hold harmless Booksfer, LLC, its members, officers and agents from any claim, loss or expense, including reasonable legal fees, arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to that jurisdiction.
If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory consumer law of your country of residence, or of the right to bring proceedings in the courts of that country.
17. Changes to these terms
We may revise these Terms as the Service develops or as the law requires. The date at the top of this page shows when they were last revised. Where a change is material, we will give notice on the Service or by email at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the revised Terms.
